Terms of Service

These Terms of Service (the “Terms”) govern the relationship between you (the “user”) and the operator of the EchoWash service (the “Operator”, “we”) when using the Service available at https://echowash.ru (the “Service”).

1. Acceptance of terms

By starting to use the Service (including by signing in, connecting your Google account or performing operations with comments), you confirm that you have read and agree to these Terms and the Privacy Policy. If you do not agree to the Terms, please stop using the Service.

2. Description of the Service

The Service allows YouTube channel owners to manage their digital footprint: search, filter and delete their YouTube comments, and import and process comment data (including through Google Takeout / the Data Portability API).

The Service is provided “as is” and “as available”: its operation depends on the availability of external APIs (Google/YouTube) that are outside the Operator’s control.

3. Account and access

• Access to the Service is provided by password and/or Google authorisation.
• You are responsible for keeping your access credentials secure and for all activities performed under your account. Do not share your credentials with third parties.
• By connecting a Google/YouTube channel, you confirm that the channel belongs to you or that you have the right to manage it.

4. Your obligations

• to comply with applicable law, the YouTube Terms of Service and the YouTube Developer Policies;
• not to infringe the rights of third parties, including copyright and other intellectual property rights;
• not to use the Service for mass spam, fraud, circumvention of restrictions or other unlawful purposes;
• to understand that deleting YouTube comments is generally an irreversible action, and to bear the risks associated with such deletion yourself.

5. Restrictions of use

It is prohibited to: hack, decompile or otherwise reverse engineer the Service software; copy, reproduce, distribute or sell the Service and its content without the Operator’s prior written consent; interfere with the operation of the Service; or resell access to the Service without the Operator’s permission.

6. Paid features and payment

• Certain features of the Service may be provided on a paid basis (subscription or one-time payment). Pricing and payment terms are published in the Service before payment.
• Payment is processed through payment providers indicated in the Service. If payment is not made, access to paid features may be suspended.
• Refunds are made in accordance with applicable law, including consumer protection legislation. Unless otherwise provided by law, the fee for a period actually provided is not refundable.

7. Intellectual property

The Service, including its interface, design, logo, texts, databases and software, belongs to the Operator or its licensors. The trademarks of YouTube, Google and other parties belong to their respective owners.

8. Disclaimer of warranties

The Service is provided “as is”. The Operator does not warrant that the Service will operate uninterrupted or error-free, or that specific comment deletion results will be achieved. The Operator is not liable for the unavailability or changes to the functionality of external APIs (Google/YouTube), or for the actions and policies of Google/YouTube with respect to your account.

9. Limitation of liability

• To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, special or other damages, including lost profits and loss of data.
• The Operator’s aggregate liability under these Terms is limited to the amount actually paid by you for the use of the Service during the 12 months preceding the event giving rise to the claim, or, if no payment was made, to the minimum amount established by applicable law.
• Deletion of comments is irreversible. The Operator is not liable for the loss of comments, their unavailability after deletion, or the consequences of deletion for your channel.

10. Indemnification

You agree to indemnify the Operator for losses, including legal costs, arising from your unlawful use of the Service or your breach of these Terms.

11. Suspension and termination

• The Operator may suspend or terminate access to the Service in case of breach of these Terms, as well as for security reasons, maintenance, or at the request of competent authorities.
• You may stop using the Service at any time, and you may disconnect your Google access and delete collected data (in the Service and at https://myaccount.google.com/permissions).
• All user data is automatically deleted from the Operator’s server upon logout or after 60 minutes of inactivity (see the Privacy Policy for details).

12. Changes to the Terms

The Operator may amend these Terms. Amendments take effect upon publication of the new version on this page. Continued use of the Service after the changes take effect constitutes acceptance of the new version. If you do not agree to the changes, please stop using the Service.

13. Governing law and dispute resolution

• The parties’ relationship is governed by the laws of the Russian Federation, except where the mandatory law of the user’s country of residence applies (in particular, for consumers in the EU/EEA).
• Disputes shall be resolved through negotiations. If no agreement is reached, the dispute is subject to resolution in court at the Operator’s registered address in accordance with the law of the Russian Federation. Consumers in the EU/EEA retain the right to bring proceedings in a court or other competent authority at their place of residence.

14. Miscellaneous

• If any provision of these Terms is held to be invalid, the remaining provisions remain in force.
• Failure by the Operator to exercise any right under these Terms does not constitute a waiver of that right.
• The Operator may transfer its rights and obligations under these Terms to a third party with notice to the user.
